Patio Covers, Shade & Awnings in Vancouver

Building By-law No. 14343 lists among the things the regulations do not apply to: accessory buildings less than 10 square metres in building area that do not create a hazard. Ten square metres is roughly 3.2 by 3.2 metres, smaller than most dining patios.

That exclusion is written for accessory buildings. A cover attached to your house is generally not one, so assume an attached patio cover or louvered roof needs permit review and treat exemption as the exception. Confirm your specific structure with the city.

Even where a building permit is not required, the Zoning and Development By-law still applies, including setbacks and site coverage. Two separate tests, and passing one says nothing about the other.

The city states that a work without permit penalty is typically double the original permit fee, that all work must stop while the application is processed, and that work already commenced may have to be removed. It also states that as the homeowner you are responsible for those fees even if you hired a contractor who assured you no permit was needed.

The city states that a development permit is required for each type of patio. In February 2023 Council amended the Zoning and Development By-law to allow permanent patios for restaurants, cabarets, cultural and recreational clubs, retail stores, neighbourhood grocery stores, neighbourhood public houses, and grocery or drug stores.

Under its private patio restrictions the city states that businesses must not enclose the patio with walls, roofs, windows, or barriers other than the required railing. That restriction belongs to the private patio permit. It does not describe what is allowed on a sidewalk or curbside patio, which are governed separately.

For a year-round permanent patio the city states a building permit will be required as part of the approval process, and that the development permit is renewed annually while the building permit is not. A summer patio runs April 1 to October 31, may move up to 50 percent of existing seats outside, must be removed by November 1, and is applied for each year.

Total guests including the patio cannot exceed your occupancy permit, and increasing it may require more customer washrooms or greater exit capacity. Service ends and customers relocate inside by 11pm.

The city states that umbrellas on a sidewalk patio can only have a single post, cannot be attached to the patio railing, and cannot extend beyond the patio footprint into the sidewalk. Tents are prohibited.

The city states that an awning requires a separate permit. If the plan is a fixed or retractable awning off the building rather than a freestanding umbrella, that is a different application, and it is worth establishing that before designing around it.

Portable heaters including propane are permitted on sidewalk patios. The city requires them to be brought inside daily at the end of each business day and to be at least 160 centimetres tall, and states that heaters under or near umbrellas are not permitted. Propane tanks must be caged and locked in a vented structure outside on private property in compliance with the BC Gas Safety Regulation.

Summer sidewalk patios run under the Summer Patio Program from April 1 to October 31.

The 2026 Summer Curbside Patio Design Guidelines state that overhead covers must be summer-appropriate, lightweight and made from flexible materials such as textiles. The approved types listed are single-post umbrellas, cantilevered umbrellas, single-pitch or dual-pitch cover, shade sails and canopy-style. They must sit between 2.1 m and 3.0 m above the patio surface, must not block the view of traffic signs or interfere with overhead utilities or trees, and must not be connected to or supported by the building.

The guidelines describe windscreens as transparent vertical extensions installed on top of railings. Windscreen and railing together must not exceed 1.6 m from the road surface. Materials must be shatter-proof and durable such as plexiglass or equivalent, and the guidelines state that glass is not permitted. They must be transparent, non-reflective and flat to preserve traffic sightlines.

Posts and open frames may be added to support lighting, accessories and lightweight overhead covers. The guidelines require frames to remain lightweight and open and state they must not be enclosed with walls or full-height panels or screens. Height must not exceed 3.0 m from the patio surface.

The city states that existing permit holders must meet the new accessibility and design requirements within three years, that all summer curbside patios must be upgraded by the 2028 patio season, and that a one-time full permit fee credit or refund will be provided once a patio is updated.
